Animals as Legal Beings is a new and important monograph-length treatment on the inadequacies of both a property and a personhood approach to the legal status of nonhuman animals. In this article, I review A Theory of Legal Personhood, explaining what I see as its key contributions to animal law scholarship, while situating it against wider jurisprudential contributions that may be of interest to philosophers and legal scholars grappling with the oft-thorny idea of legal personhood, not just for nonhuman animals but for corporations, artificially intelligent machines, and late-term fetuses. The article will explain Kurki's “bundle” theory of legal personhood as a “cluster” concept and analyze the extremely helpful parsing (...) his theory provides in terms of the active and passive “incidents” of legal personhood. I focus much of the piece on Kurki's view of legal “nonpersons” who nonetheless have some rights or incidents of personhood in order to help clarify the challenge Kurki's theory raises for Steven M. Wise and the Nonhuman Rights Project, as the issues surrounding those litigation efforts will likely be familiar to readers here, who will be wondering how this theory interacts with what Wise seeks to achieve. Background: The high level of satisfaction of users of a health service is largely due to the fact that they receive excellent care from healthcare professionals. Compassionate care is an essential component of excellent care. But what do nurses understand compassion to be? Research objectives: To analyse the concept of compassion from the perspective of nurses in the Andalusian Public Health System, Spain. Research design: This is a qualitative study following the grounded theory model. Four focus groups and 25 in-depth (...) interviews were conducted. Participants and research context: A total of 68 nursing professionals working in the Andalusian Public Health System (Spain) participated. Theoretical sampling was used, with participants being recruited using the snowball technique. Ethical considerations: This research was approved by the Research Ethics Committee of the Centro-Almería Health District (CEICA 27/9/17). Findings: From the analysis of the data, four themes emerged that helped to understand the concept of compassion according to nurses: ‘Negative perception of the term compassion’, ‘Compassion and empathy as synonyms’, ‘Beyond empathy’, and ‘Effects of having a compassionate attitude’. Discussion: Nurses perceive the concept of compassion differently to each other and even contradictorily. This concept is imbued with cultural elements, which adds confusion to understanding it, and is even perceived as something negative similar to pity. Conclusion: Nurses confuse the concepts of empathy and compassion as if they were synonymous. Before considering training in compassion for healthcare professionals, it is essential to clarify the concept of compassion through educational interventions. (shrink)

Little has been studied on the relationship between affect and school problems related with attendance. This study aims to identify different affective profiles and to determine whether these profiles differ from each other based on the four functional conditions of school refusal behavior. Participants comprised 1,816 Spanish adolescents aged 15–18 years. The Positive and Negative Affect Schedule for Children-Short Form and the School Refusal Assessment Scale-Revised for Children were administered. Latent profile analysis revealed five affective profiles: low affective profile, self-fulfilling (...) profile, low positive affect profile, self-destructive profile, and high affective profile. The self-destructive profile revealed the highest average scores in the first three factors of the SRAS-R-C, whereas the high affective profile reached the highest average score in the fourth factor. On the contrary, the self-fulfilling profile obtained the lowest average scores in the first two factors of the SRAS-R-C, whereas the low affective profile revealed the lowest average scores in the last two factors. Findings suggest the relevance of developing more adaptative affective profiles, such as the self-fulfilling profile, which would contribute to diminishing school attendance problems. (shrink)

It can be stated that self-regulated learning (SRL) brings broad benefits to the process of students' learning and studying. However, research has yet to be undertaken in relation to one of its components, namely self-regulation of motivation and affectivity. The main objectives of this study are to examine the use of self-motivation strategies that involve classmates and to obtain models on the influence of academic goals and self-efficacy on such self-motivation strategies. To this end, was conducted a study using two (...) different samples of students in the compulsory secondary education or baccalaureate stages in Spain (N = 613 and N = 910). The results obtained indicate that, with regard to gender, differences only exist in the use of the strategy of deception (t = 5.450, p <.001, d =.364). That the two pairs of strategies positively and significantly correlated with one another (r =.239, p <.01 and r =.355, p <.01). That only the strategy of annulation of others correlates with a more adaptive type of motivation. Thus, the group of students that reported the greatest level in its use also did so in relation to task and ego self-enhancing goals, to self-efficacy, and being negatively associated with the goal of work avoidance. Finally, were offered models on relationships between academic goals, self-efficacy and enhancement and annulation strategies (χ² (8) = 5.204, p =.736) and deception and annulation strategies (χ² (4) = 3.228, p =.520). The concept of vital force – the immanent energy that promotes the processes of life in the body and in nature – has proved a source of endless fascination and controversy. Indeed, the question of what vitalizes the body has haunted humanity since antiquity, and became even more pressing during the Scientific Revolution and beyond. Examining the complexities and theories about vital force in Spanish modernity, Nicolás Fernández-Medina's Life Embodied offers a novel and provocative assessment of the question of (...) bodily life in Spain. Starting with Juan de Cabriada's landmark Carta filosófica, médico-chymica of 1687 and ending with Ramón Gómez de la Serna's avant-gardism of the 1910s, Fernández-Medina incorporates discussions of anatomy, philosophy, science, critical theory, history of medicine, and literary studies to argue that concepts of vital force served as powerful vehicles to interrogate the possibilities and limits of corporeality. Objetivo: analizar las tendencias de la formación bioética e intercultural en los programas de enfermería, y establecer los aspectos que deben contemplarse para mejorar la formación. Materiales y método: búsqueda de información en bases de datos científicas de acceso libre y repositorios de tesis doctorales de universidades; se utilizaron las palabras clave: “Bioética”, “Educación”, “Formación”, “Enfermería”, “Cultura”, en español e inglés. No se establecen límites según la fecha de publicación. Resultados: la mayoría de investigaciones se enfocan en el currículo académico, (...) hay poca información sobre interculturalidad, pero se retoma el tema de transculturalidad. Fernandez examines the lives and ideas of sociologists who shaped the main contours of the discipline. Weber, Marx, Durkheim, and Simmel fashioned the early ideas and approaches of sociology, and their ideas are still central to the discipline. Veblen, Mead, Goffman, and Berger added crucial conceptual approaches; they also serve to underscore the length and breadth of Sociology as a science.

Public-private partnerships are established to specifically harness the potential of Big Data in healthcare and can include partners working across the data chain—producing health data, analysing data, using research results or creating value from data. This domain paper will illustrate the challenges that arise when partners from the public and private sector collaborate to share, analyse and use biomedical Big Data. We discuss three specific challenges for PPPs: working within the social licence, public antipathy to the commercialisation of public sector (...) health data, and questions of ownership, both of the data and any resulting intellectual property or products. As a specific example we consider the case of the UK National Health Service providing patient data to Google’s DeepMind AI program to develop a diagnostic app for kidney disease. This article is an application of the framework presented in this issue of ABR. Please refer to that article for more information on how this framework is to be used, including a full explanation of the key values involved and the balancing approach used in the case study at the end. We use four specific values to help analysis these issues: public benefit, stewardship, transparency and engagement. Throughout March and April 2020, debate raged about how best to allocate limited intensive care unit (ICU) resources in the face of a growing COVID-19 pandemic. The debate was dominated by utility-based arguments for saving the most lives or life-years. These arguments were tempered by equity-based concerns that triage based solely on prognosis would exacerbate existing health inequities, leaving disadvantaged patients worse off. Central to this debate was the assumption that ICU admission is a valuable but scarce resource in the (...) pandemic context.In this paper, we argue that the concern about achieving equity in ICU triage is problematic for two reasons. First, ICU can be futile and prolong or exacerbate suffering rather than ameliorate it. This may be especially true in patients with COVID-19 with emerging data showing that most who receive access to a ventilator will still die. There is no value in admitting patients with poor prognostic indicators to ICU to meet an equity target when intensive critical care is contrary to their best interests. Second, the focus on ICU admission shifts focus away from important aspects of COVID-19 care where there is greater opportunity for mitigating suffering and enhancing equitable care.We propose that the focus on equity concerns during the pandemic should broaden to include providing all people who need it with access to the highest possible standard of end-of-life care. This requires attention to culturally safe care in the following interlinked areas: palliative care, communication and decision support and advanced care planning. (shrink)

Partimos de que en sociedades políticas complejas, aun siendo el Estado un artificio necesario para evitar situaciones de dominación, su entramado institucional no está exento de reproducir análogas situaciones a aquellas cuya eliminación justificaba su existencia. Analizaremos desde esta óptica las críticas de Rawls y Nozick al utilitarismo, al que acusan de amparar actuaciones injustas por parte del colectivo hacia los individuos. En concreto, abordaremos el problema de los derechos inviolables desde estas tres líneas de pensamiento para concluir que, a (...) pesar de que existen marcadas diferencias en sus respectivos planteamientos metodológicos, hay en las tres líneas de convergencia en lo sustantivo. Concluiremos con una réplica a las objeciones antiutilitaristas y una defensa, siguiendo a John Stuart Mill de la mayor adecuación de esta escuela a la hora de defender la inviolabilidad de ciertos derechos fundamentales. This paper aims to show that to reduce the level of exploitation present in (some) international clinical trials, research sponsors must aim to provide both an ex-ante expected gain in utility and a fair ex-post distribution of benefits for research subjects. I suggest the following principles of fair risk distribution in international research as the basis of a normative definition of fairness: (a) Persons should not be forced (by circumstance) to gamble in order to achieve or protect basic goods; (b) (...) In cases where one party is gambling with basic goods and the other party is not, the distribution of benefits and burdens must be arranged so that they are of greatest benefit to the worst off; (c) In relationships where one party is gambling for basic goods and the other party is not, the party gambling for basic goods must be assured of some guaranteed benefits in addition to the chance of gaining some potential benefits.These principles are applied to the case of HIV international research. I conclude that the research (as described) is mutually advantageous but still exploitative because the distribution of surplus benefits is unfair. It is unfair because research subjects are gambling with and for basic goods but they are not assured of a fair ex-post distribution of benefits. Principles (b) and (c) are not satisfied. Research participants are not accorded enough guaranteed benefits to outweigh the risks they undertake. (shrink)

El debate sobre si procede establecer un paralelismo entre las _Meditaciones _y la actividad jurídica y política de su autor ha llevado a la historiografía a plantear diversas hipótesis en cuanto a la adscripción filosófica de Marco Aurelio. Teniendo en cuenta estos trabajos previos, nos preguntamos cómo abordar el pasaje _Med. _VI, 44, en el que Marco Aurelio se pregunta por la providencia divina. El tema parece retomar un debate propio de la filosofía helenística con un vocabulario y un planteamiento (...) típicamente estoicos, pero su finalidad ya no es meramente teológica ni su posicionamiento sigue la ortodoxia de esta escuela. La inspiración estoica le permite defender la exigencia del culto a los dioses mediante ritos institucionalizados, aunque filosóficamente no pueda concluirse con certeza la existencia de la divinidad. Para alcanzar este objetivo reproduce la posición del Cota ciceroniano, quien, en _De natura deorum_, representa la posición del pontífice que debe proteger los ritos religiosos y el filósofo que busca una fundamentación teórica que facilite su defensa. De esta manera, Marco Aurelio, como antes Cicerón, politiza al servicio de Roma un debate que, en un primer momento, se hallaba circunscrito a la teología. (shrink)

In their response to ‘Public interest in health data research: laying out the conceptual groundwork’, Grewal and Newson critique us for inattention to the law and putting forward an impracticably broad conceptual understanding of public interest. While we agree more work is needed to generate a workable framework for Institutional Review Boards/Research Ethics Committees, we would contend that this should be grounded on a broad conception of public interest. This broadness facilitates regulatory agility, and is already reflected by some current (...) frameworks such as that found in the guidelines approved under Australia’s Privacy Act. It remains unclear which elements of our broad account Grewal and Newson would reject, or indeed where the substantive disagreement with our position lies. (shrink)

This target article considers the ethical implications of providing prenatal diagnosis (PND) and antenatal screening services to detect fetal abnormalities in jurisdictions that prohibit abortion for these conditions. This unusual health policy context is common in the Latin American region. Congenital conditions are often untreated or under-treated in developing countries due to limited health resources, leading many women/couples to prefer termination of affected pregnancies. Three potential harms derive from the provision of PND in the absence of legal and safe abortion (...) for these conditions: psychological distress, unjust distribution of burdens between socio-economic classes, and financial burdens for families and society. We present Iran as a comparative case study where recognition of these ethical issues has led to the liberalization of abortion laws for fetuses with thalassemia. We argue that physicians, geneticists and policymakers have an ethical and professional duty of care to advocate for change in order to ameliorate these harms. (shrink)

In most states in the U.S. it is legal to carry a concealed handgun in public, but little is known about why people want to do this. While the existing literature argues that guns symbolize masculinity, most research on the actual use of guns has focused on marginalized men. The issue of concealed handguns is interesting because they must remain concealed and because relatively privileged men are most likely to have a license to carry one. Using in-depth interviews with 20 (...) men, this article explores how they draw on discourses of masculinity to explain their use of concealed handguns. These men claim that they are motivated by a desire to protect their wives and children, to compensate for lost strength as they age, and to defend themselves against people and places they perceive as dangerous, especially those involving racial/ethnic minority men. These findings suggest that part of the appeal of carrying a concealed firearm is that it allows men to identify with hegemonic masculinity through fantasies of violence and self-defense. (shrink)

Pocas veces ha habido mayor afinidad entre un filósofo y un científico. Este libro (de 191 páginas) descubre cómo Julián Marías conoció a Jérôme Lejeune en 1980, y ambos resultan muy afines: los dos afirman la unicidad (calidad de único) de cada persona, algo que durante la Edad Media se reservaba a muy pocos seres de este mundo: el Sol, la Luna o la Tierra, pero no se aplicaba a cada persona, considerada como miembro de una especie única porque se (...) creía que su principio de individuación era la materia señalada por la cantidad (estos huesos y esta carne, no agotados en cada individuo). Además, se consideraba que solo había persona cuarenta días después de la concepción en el caso del varón, y noventa en el caso de la mujer. El presente libro (que traduce por primera vez al español algunos textos en francés tanto de Lejeune como de Marías y que parte de la genética moderna descubierta por Lejeune, así como de la metafísica de Marías, la cual considera "mi vida" como la realidad radical) muestra cómo estos dos grandes humanistas supieron ir a contracorriente, usando la razón y la ciencia, para proteger al no nacido. Social capital has as its key element the value of social relationships to generate positive outcomes, both for the key parties involved and for wider society. Some authors have noted that social capital nevertheless has a dark side. There is a moral element to such a conceptualisation, yet there is scarce discussion of ethics within the social capital literature. In this paper ethical theory is applied to four traditions or approaches to economic social capital: neo-capitalism; network/reputation; neo-Tocquevellian; and development. Each (...) is considered in detail and subject to ethical analysis by the application of utilitarianism, Kantianism, justice and rights, and ethic of care. Accordingly, the assumption that social capital is either value-neutral or a force for good is critiqued, and a framework for understanding social capital from an ethics perspective is presented. En el presente artículo expondremos las ideas del sociólogo polaco Zygmunt Bauman sobre la comunidad y su destrucción moderna. Estas ideas, complementadas por las del filósofo español Juan B. Fuentes, se analizarán críticamente y de manera conjunta con las propuestas positivas de cada autor, señalando algunas diferencias menores pero importantes. Finalmente, se discutirá el caso de las “comunidades virtuales”, comprobando si los análisis precedentes siguen sirviéndonos para entender estas nuevas realidades.

La versión de la teoría descriptiva de la referencia que tomamos en consideración es la propuesta por Searle y Strawson, y en nuestra réplica a los contraejemplos más importantes de Donnellan hacemos hincapié en dos de los tipos de descripciones o propiedades a las que estos (...) autores apelan, a saber, las propiedades involucradas en la capacidad de reconocimiento asociada con un nombre y las descripciones parásitas. The aim of this paper is to examine the most important counterexamples put forward by Keith Donnellan against the description theory of the reference of proper names, as well as to present a reply to them. The version of the description theory of reference we take into consideration is the one proposed by Searle and Strawson, and in our reply to Donnellan's most important counterexamples we emphasize two of the sorts of descriptions or properties these authors resort to, that is, the properties involved in the capacity of recognition associated with a name and the parasitic descriptions. La denominada 'estrategia del explanandum dual' ha sido utilizada en el pasado para enfrentar problemas de distinta clase, entre los que se cuentan el debate 'explicación vs. comprensión' y el problema de cómo las razones pueden explicar la conducta. Esta estrategia puede ser descripta someramente como un intento de resolver la rivalidad explicativa entre dos explicaciones por medio de la división del explanandum. En este artículo se analiza el uso que Ausonio Marras ha hecho de ella. Este autor ha sostenido (...) que su utilización permite enfrentar el problema de la ineficacia causal de las propiedades mentales, problema que ha representado una seria amenaza en las últimas dos décadas para el programa del materialismo no reduccionista. Se intentará mostrar que la estrategia sugerida no puede ser exitosa frente a este problema a menos que pueda proveerse de una explicación exitosa de cómo las propiedades mentales pueden mantener su eficacia causal completa, y que la respuesta que se ofrece no satisface esta exigencia. The dual explanandum strategy' has been used in the past to contend some quite different problems, including the 'explanation vs. understanding' debate and the problem of how reasons can explain behavior. This strategy can be roughly described as an intent to solve the explanatory rivalry between two explanations by means of the division of the explanandum. In this paper I want to analyze the use of this strategy by Ausonio Marras, who has claimed that it allows us to face the problem of causal inefficacy of mental properties. This problem has arisen in the last two decades in the context of non reductive materialism and has become a serious menace to this program. I try to show that this strategy can not work out this problem unless it can be provided with a successful account of the way that mental properties can keep their complete causal efficacy, and the answer he offers does not satisfy this demand. Hacemos en el presente trabajo un pequeño recorrido a propósito de las manifestaciones o expresiones de ateísmo y materialismo, popular y culto, a fines del siglo XVIII y dos primeras décadas del siglo XIX, a partir, sobre todo, de los archivos inquisitoriales del Tribunal de Santiago de Compostela o Galicia. empleando una metodología mixta (historia conceptual, antropología cultural, historia de las ideologías, historia de la filosofía, etc.) y en base a fuentes documentales del siglo XIX tomadas del Archivo Histórico de (...) la Universidad de Santiago de Compostela (poco conocidas) o del Archivo Histórico Nacional de Madrid (inéditas), arqueológicamente, intentamos reconstruir 25 agitados años de la historia de la cultura gallega, centrándonos muy especialmente en la historia del pensamiento filosófico.
